Attorney Peter Kelley and Attorney Mary Azzarito obtain defense verdict

Following a three week jury trial in Plymouth Superior Court in Brockton, Attorney Peter Kelley and Attorney Mary Azzarito were successful in securing a defense verdict for an obstetrician and a labor and delivery nurse in a case involving a stillbirth.

Plaintiff brought this wrongful death claim alleging the Obstetrician and L&D Nurse failed to properly monitor and manage a patient presenting at 36 weeks with hypertension/preeclampsia and abdominal pain such that a diagnosis of placental abruption was delayed. Plaintiff claimed the alleged delay resulted in a stillbirth and the mother's subsequent complications with DIC that required the mother's transfer for tertiary care and a three-week hospitalization. In addition, the Plaintiff claimed the Obstetrician failed to evaluate the patient in a timely manner and that initial communication between the Nurse and Doctor failed to meet the standard of care.

The Jury returned its verdict finding no negligence by the physician and the nurse following approximately five hours of deliberation.
